PANTECH DESIGN LLC PRIVACY POLICY


This Privacy Policy explains how information (“Information”) about you (whether you have a direct documented relationship or written agreement with p|d as a distributor or licensee or you have an indirect permitted relationship with p|d as a customer, permitted user or sub-licensee of any p|d authorized distributor or licensee, “You”) is collected, used and disclosed by PanTech Design LLC, our affiliates, business units, divisions, subsidiaries, joint ventures, successors and assigns (collectively, “p|d” or “We” or “Us”) when You use our websites, including without limitation, www.pantechdesign.com, www.PDADAPT.com, the PD ADAPT Portal and any other websites, web-based portals or downloadable software applications created, hosted or supported by p|d (each a “Site” and, collectively, “Sites”), and other products, software or services, or when You otherwise interact with Us.  “You" includes, without limitation, p|d customers and licensees, together with any customers, sub-licensee or permitted end-users of any p|d Site, product, software or service.
This Privacy Policy may be distributed in a printed format and may be found on any of the Sites.  We may change this Privacy Policy from time to time. We encourage You to review the Privacy Policy closely and to check for updates or changes whenever You access any of our Sites to stay informed about our most current information practices and the ways You can help protect your privacy.  
For purposes of this Privacy Policy, “Information” includes any information You provide to Us, including information obtained from your use of a p|d Sites, products, software and services, as well as the use by any of your customers, sub-licensee and permitted end-users of any p|d Site, product, software or services any data obtained from your use of any of our Sites, software, products or services.  “Personal Information” includes Information that alone or when in combination with other information may be used to readily identify, contact, or locate You or a specific individual,.


I.    INFORMATION COLLECTED.
By using any of our Sites or by acquiring, downloading or accessing any of our products, software or services, You consent to the collection and use of your Personal Information by p|d consistent with applicable data protection laws and this Privacy Policy, which is expressly incorporated into any applicable Website or p|d product, software or service Terms of Use.  You also represent to Us that You have any and all authorizations necessary to use the Sites and any p|d product, software or service, including using them to collect, store, or process Personal Information. p|d collects and uses Information in order to provides its services. We may use or share Personal Information (e.g., name, address, telephone number, email address, location, etc.) where it is necessary for Us to complete a transaction or do something that You have asked Us to do.  Also, We may use Information, including Personal Information that has been de-identified and aggregated with other information, that We collect for our internal purposes to develop, tune, enhance, and improve our products, software or services, and for advertising and marketing and other purposes consistent with this Privacy Policy. By using p|d products, software or services or any of our Sites, You acknowledge, consent and agree that p|d may collect, process, and use Information that you provide to Us and that such Information may be used by p|d or third parties acting under the direction of p|d to develop, tune, enhance, and improve p|d Sites, products, software or services and for advertising and marketing and other purposes consistent with this Privacy Policy.
When You access or use any of our Sites, products, software or services, We may automatically collect Information about You, including:
i.    Registration Information:  When registering for one of our Sites or acquiring, downloading, accessing or using any of our products, software or services, We may request your name, address, date of birth, telephone number, email address, and payment information, among other details.

ii.    Usage Information: When You acquire, download, access or use our software or services or use one of our Sites to download, access or use our services, We collect Information about these interactions, including the time, date, nature, content and communications of your access or use, among other details.  

iii.    Log Information: We log information about your use of our Sites, including your browser type and language, access times, pages viewed, your IP address and the website You visited before navigating to our Sites.

iv.    Device Information: We may collect information about the computer or device You use to access our Sites, products, software or services, including the hardware model, operating system and version, MAC address, unique device identifier, phone number, International Mobile Equipment Identity (“IME”) and mobile network information.

v.    Location Information: We may collect information about the location of your device to facilitate your use of certain features of our Sites, products, software or services, to determine the speed at which your device is traveling, add location-based filters to your messages, and for any other purpose described in this Privacy Policy.

vi.    Information Collected by Cookies and Other Tracking Technologies: We use various technologies to collect information, and this may include sending cookies to You. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Site and your experience, see which areas and features of our Sites are popular and count visits. Most web browsers are set to accept cookies by default. If You prefer, You can usually choose to set your browser to remove or reject browser cookies. Please note that if You choose to remove or reject cookies, this could affect the availability and functionality of our Sites.

vii.    Other Sources:  We may also obtain information from other sources and combine that with information We collect through the Sites, products, software or services.


II.    USE OF INFORMATION.
p|d (or p|d vendors and suppliers) may observe your activities, preferences, and transactional data (such as your IP address, browser type, equipment type, content selections, duration and frequency of use or access, among other details) as well as related usage behavior depending on whether You are using our Sites for a particular p|d product, software or service. We may use this data in an anonymous and aggregated format for any purpose, unless We tell You otherwise, in connection with a particular Site, product, software or service.
i.    Usage. You may be asked to share Personal Information when You acquire, license, download, access or use p|d Sites, products, software or services, transmit files, seek user or technical support or otherwise interact with p|d by any means. If products or services are purchased from p|d, or any p|d dealer, licensee or agent, these purchase transactions may be conducted or facilitated through p|d vendors and suppliers. Vendors and suppliers engaged by P|d on behalf of p|d may make use of your Personal Information limited by this Privacy Policy, contractual restrictions, and applicable law. p|d (through its vendors or suppliers) may limit the acceptance of orders to particular jurisdictions and as permitted by applicable law. You may also make purchases of p|d services; seek customer or technical support through p|d’s distributors or service providers. In these circumstances, the collection of your Personal Information may occur directly by the distributor or service provider or a third-party partner on their website or integration or sub-licensing of software, and which may be accessible by Us in accordance with this Privacy Policy and applicable laws.  Information associated with your account may be kept indefinitely.

ii.    Children. Our Sites, products, software or services are not directed at children. If You are under 18 or otherwise would be required to have parent or guardian consent to share information with p|d You should not send any information about yourself to Us. As required by law, if a person under 13 submits information through any part of a p|d Site, product, software or service, and We learn the person submitting the information is such a child, We will attempt to delete this information as soon as possible.


III.     SHARING OF INFORMATION.
p|d may share Personal Information within p|d to fulfill its obligations to You and operate its business consistent with this Privacy Policy and applicable data protection laws. In addition to what is expressly stated in this Privacy Policy, We may also share your Personal Information with third parties in the following situations:
i.    P|d Vendors and Suppliers. p|d works with third parties, vendors, distributors, and suppliers. To the extent it is necessary for these groups to provide their products and services to Us and provide products and services You have requested, these third parties may have access to or process your Personal Information. p|d may also sometimes permit our authorized service providers to have access to aggregate statistics about our customers, sales, traffic patterns, and related Sites’ information. These transfers of aggregate statistics do not involve Personal Information .

ii.    Enabling Services. p|d offers a variety of services and functions through our Sites (“P|d Services”). Personal Information that is collected through  our Sites may be used and/or disclosed to third parties in order to enable Us to provide p|d Services to  You.

iii.    Mergers, Acquisitions, and Insolvency. If p|d should ever file for bankruptcy or merge with another company, or if p|d should decide to buy, sell, or reorganize some part or all of its business, p|d may be required to disclose your Information, which may include Personal Information, to prospective or actual purchasers in connection with one of these transactions.

iv.    As Required by Law and Other Extraordinary Disclosures. p|d may be required to disclose your Personal Information if it: (i) believes it is reasonably necessary to comply with legal process (such as a court order, subpoena, search warrant, etc.) or other legal requirements of any governmental authority, (ii) would potentially mitigate our liability in an actual or potential lawsuit, (iii) is otherwise necessary to protect our rights or property, or (iv) is necessary to protect the legal rights or property of others.

v.    Analytics Services Provided by Others.  We may allow others to provide analytics services on our behalf. These entities may use cookies, web beacons and other technologies to collect information about your use of any of our Sites and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand your online activity.

We may work with a third party company to provide analytics in connection with the p|d mobile application. For more information about the third party company’s privacy practices, You should visit their site directly.  To opt-out of Analytics tracking used with the p|d mobile application the third party company can provide You with means of opting-out upon request. IV.    FEEDBACK.
    When using our products, software or services, or any of our Sites, We may request feedback from You as to how the products, software or services are performing and You are invited to submit suggestions for improvement or comments related thereto (“Feedback”).  Providing Feedback is voluntary, however, if You provide it to Us, You consent to the collection, storage, and use of the Feedback by Us in any manner, and We retain all rights to make use of and distribute such Feedback as necessary to improve our services or for any other purpose.

V.    SECURITY.
If p|d learns of a security system’s breach, We may attempt to notify You electronically so that You can take appropriate protective steps. By using any of our Sites or providing Personal Information to Us, You agree that We can communicate with You electronically regarding security, privacy, and administrative issues relating to your use of our Sites. p|d may post a notice on our Sites if a security breach occurs. If this happens, You will need a web browser or mobile device enabling You to view our Sites. p|d may also send an email to You at the email address You have provided to Us in these circumstances or communicate with You by other means if We can. Depending on where You live, You may have a legal right to receive notice of a security breach in writing.


VI.    LINKS TO THIRD-PARTY WEBSITES AND CO-BRANDED WEBSITES.
Our Sites may contain links to third-party websites, however, please be aware that p|d is not responsible for and cannot control the privacy practices of these other websites. We encourage You to read the privacy policies for these other websites, as they may differ from ours. This Privacy Policy applies solely to information collected by p|d on any of our Sites.


VII.    SPECIAL NOTICE TO INTERNATIONAL VISITORS AND CUSTOMERS.
P|d is based in the United States and the information We collect is governed by U.S. law. By accessing any of our Sites or using our products, software or services or otherwise providing information to Us, You consent to the processing and transfer of information in and to the U.S. and other countries.
Because p|d may operate globally, We may transfer your Personal Information within our global operations to fulfill our obligations to You, but always subject to the limitations of applicable data protection law and this Privacy Policy. Privacy laws differ across the globe.
If You are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, including those whose privacy laws may be more strict than U.S. law, please note that You are transferring your personal data to the United States to p|d. By providing your personal data You consent to that transfer and processing.


VIII.    CALIFORNIA.
California law permits residents of California to request certain details about what personal information a company shares with third parties for the third parties’ direct marketing purposes.  Learn more about the information We receive and how it is used and other websites and applications. IX.    MARKETING COMMUNICATIONS.
When You provide p|d with Personal Information, We may communicate with You using the information You have given Us to provide You with information We think may be of interest to You.


X.    ENFORCEMENT AND MORE INFORMATION.
Department of Commerce’s website at: http://export.gov/safeharbor/. When p|d receives formal written complaints, it is p|d’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between p|d and an individual.
